Service Liability Statement – Terms of Service Agreement
Information Technique – IT Support and its agents, technicians and service representatives (hereafter referred to as Information Technique) will use its best efforts to resolve client technical problems in a professional, reasonable and timely manner, taking into consideration the circumstances and nature of the technical problems. Information Technique does not assure that every request for technical support can or will be resolved. Technical problems may be a result of software or hardware failure, data corruption or user error and may not be correctable.
You understand and agree that prior to contacting or allowing Information Technique to perform diagnostic repair or other services on your computer, it is your responsibility to back-up all data, software, information or other files stored on your computer disks and/or drives. You acknowledge that due to the nature of the services being performed there is potential risk of damage or loss including, but not limited to, damage to the client’s home, office, computer hardware, cabling, hubs, routers, switches, peripherals, accessories, and furniture, as well as potential risk of damage, corruption, or loss of computer software, applications, data, and data storage media. You acknowledge and agree that Information Technique shall not be responsible under any circumstance for any damage, loss or corruption of data, software or hardware.
You agree to pay fees in accordance with Information Technique’s current rates and policies.
You certify that you are the expressed owner of the equipment described in this document and you grant permission to physically access your home or office property where your computer system and/or network reside.
You understand that Information Technique is not an authorized service dealer and support rendered by Information Technique may void manufacturer warranties for your computer system. Information Technique does not assume any liability or warranty in the event that the manufacturer warranties are voided.
You authorize Information Technique to perform work on your computer equipment and property as required:
- You grant Information Technique access and permission to physically disassemble and install hardware in your computer systems and peripherals.
- You grant Information Technique access, passwords, security rights, and permission to open, view, modify, edit, delete, or otherwise manipulate your computer software, applications, data, and data storage media.
- You grant Information Technique permission to download and/or install software on your computer and peripherals.
Limitation of Liability and Release
Information Technique will not be held responsible for any problems arising from software or hardware installed on your computer by our technicians, you, or any other third party.
Information Technique will not be held liable for lost data due to hardware failure, virus, spyware, corruption or any other situation. If any problems with software or hardware arise, it is your responsibility to obtain support from the manufacturer of the product at fault.
Under no circumstances shall Information Technique be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by Information Technique or out of the installation, removal, use of, or inability to use your computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder.
By signing this form, you agree to release and hold harmless Information Technique from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by Information Technique. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals as a result of Information Technique’s actions or the actions of its agents, partners, and/or third-party service providers.
